APPLICANT REQUESTS THAT:

Her 14 Jun 12 Fitness Assessment (FA) be declared void and removed from the Air Force Fitness Management System (AFFMS).

APPLICANT CONTENDS THAT:

She was ill on 14 Jun 12 and could not complete the FA, and questions the abdominal circumference (AC) measurement.  In accordance with AFI 36-2905, Fitness Program, Air Force Guidance Memo 2, her commander signed a memo invalidating the FA and directed it not be entered into the AFFMS.  

The applicant’s complete submission, with attachment, is at Exhibit A.

STATEMENT OF FACTS:

The applicant served in the Regular Air Force in the grade of   Staff Sergeant on the date of the FA in question.

On 14 Jun 12, the applicant failed her FA, obtaining a composite score of 8.3 points for an AC measurement of 37.5 inches.

AIR FORCE EVALUATION:

AFPC/DPSIM recommends denial, indicating there is no evidence of an error or injustice.  The applicant indicates she was ill on the date of her FA; however, no documentation was provided which indicates she reported to the medical treatment facility for medical evaluation.  Although the unit commander signed a memo indicating the FA was invalid, in accordance with AFI 36-2905, the authority to take this course of action is predicated on a medical evaluation.  The applicant’s failure to provide a medical evaluation makes the unit commander’s memo invalid.

APPLICANT'S REVIEW OF AIR FORCE EVALUATION:

A copy of the Air Force evaluation was forwarded to the applicant on 18 Oct 13 for review and comment within 30 days.  As of this date, no response has been received by this office (Exhibit D).

THE BOARD CONCLUDES THAT:

1.  The applicant has exhausted all remedies provided by existing law or regulations.

2.  The application was timely filed.

3.  Insufficient relevant evidence has been presented to demonstrate the existence of an error or injustice.  We took notice of the applicant’s complete submission in judging the merits of the case; however, we agree with the opinion and recommendation of the Air Force office of primary responsibility (OPR) and adopt its rationale as the basis for our conclusion the applicant has not been the victim of an error of injustice.  Therefore, in the absence of evidence to the contrary, we find no basis to recommend granting the relief.

THE BOARD DETERMINES THAT:

The applicant be notified the evidence presented did not demonstrate the existence of material error or injustice; the application was denied without a personal appearance; and the application will only be reconsidered upon the submission of newly discovered relevant evidence not considered with this application.
